SUBJECT MATTER OF THE GENERAL TERMS AND CONDITIONS 1.1. These General Terms and Conditions hereby set out the terms and conditions for entering into Contract for Tuition of children from 2 to 5 years of age in PRIVATE PRESCHOOL “ST. GEORGE” EOOD (hereinafter referred to as the PRESCHOOL). They stipulate the relationship between the PRESCHOOL and the CHILDREN’S PARENTS/GUARDIANS during the regulated PRESCHOOL time.
1.2. The contract with the PRESCHOOL may be signed after application and completed procedure of enrollment of the CHILD in the PRESCHOOL pursuant to the rules adopted by the PRESCHOOL and paid in full Administrative fee.
1.2.1. For a CHILD who has not been subject to admission and enrollment procedure a Tuition contract with the PRESCHOOL may not be signed.
1.2.2. The admission procedure is carried out in the following cases:
1.2.2.1. The CHILD applies to the PRESCHOOL for the first time;
1.2.2.2. The CHILD has not been enrolled or has not attended the PRESCHOOL for 2 /two/ calendar months or more.
1.2.2.3. The contract has been terminated by wish or by fault of the PARENTS/GUARDIANS, including due to full or partial failure to pay or delay of payment of any fee or failure on part of the PARENTS/GUADIANS to adhere to policies and procedures of the PRESCHOOL.
1.3. The admission procedure includes:
1.3.1. Submission of Admission Application by electronic means– an Admission Application is considered valid in case it includes all and comprehensive information in each one of its sections.
1.3.2. Payment of Administrative fee – one-time payment, which is due when applying for the Preschool and an application is submitted. It covers the expenses for reviewing the documents and subsequent administrative activities. Not refundable except in cases of denied admission due to lack of free place in the respective age group.
1.3.3. Interview with the PARENTS/GUARDIANS.
1.3.4. Resolution for admission.
1.3.5. Within 10 /ten/ days after the receipt of admission confirmation and defining the enrollment date: 1. A Tuition Contract is signed; 2. A guarantee deposit is paid (within 3 days after the date of concluding the contract); 3. Tuition fee or first installment of the Tuition fee is paid (within 7 days after the date of concluding the contract).
1.3.5.2. In case there are no free places the PARENTS/GUARDIANS may fill in a Waiting List Application and will be informed by the PRESCHOOL for the first availability for enrollment. Only in cases of denied admission due to lack of free place in the respective age group for more than 2 (two) months as of the date of entry in the Waiting list, the paid Administrative fee is a subject of reimbursement.
1.4. In case of signing of a Tuition contract of a CHILD and after the expiration of the first 30 /thirty/ days of visits of the CHILD in the PRESCHOOL, a report by the Management of the PRESCHOOL is prepared with the purpose of analysis of the CHILD’s group adaptation and also the level of socialization. In case of insufficient level of integration and adaptation, the PRESCHOOL has the right to propose to the PARENTS/GUARDIANS to move the CHILD to another educational institution and/or terminate the contract in accordance with the conditions, stipulated in Section V of the present General Terms and Conditions as the PRESCHOOL bears no responsibility for any expenses, compensations, material and non-material damages.
1.5. The CHILD is provided:
1.5.1. The CHILD receives education according to the age group, following a program system coordinated with RUO – Sofia city for the different school years according to the State Educational Standards of the Ministry of Education and Science of Bulgaria, the active legislation in the system of preschool education as well as preparation for internationally recognized programs (the type is at the discretion of the management of the PRESCHOOL.).
1.5.1.1. In case of danger or epidemic spread of contagious diseases, determined by the respective act/order from the state or municipal body, declared state of emergency or extreme epidemic situation according to art. 63 from the Health Law or in case of deliberate order of a competent and authorized state or municipal body, with which classes have been suspended, the PRESCHOOL offers materials to work from home or remotely online environment interaction as far as and if possible and depending on the age of the child through the use of information and communication technologies. Situations in an online environment are not offered to the children from the 2-3 years old age group.
1.5.2. A program for tuition, literacy and education in a natural foreign language environment.
1.5.3. Identification of logopaedic status – twice a year for children who are aged 4 years and above.
1.5.4. Qualified medical care pursuant to Ordinance № 3/2000 of the Ministry of Health.
1.5.5. Other activities related to the curriculum.
1.5.6. Annual Accident Insurance.
1.5.7. Out-of-school visits to museums, fire station, zoo, theatrical performances, and other according to the age and the programme of the age group.
TERM OF THE CONTRACT AND SIGNING OF A PAYMENT PLAN FOR THE NEXT SCHOOL YEAR 2.1. The duration of the Tuition Contract shall be defined in each individual contract.
2.2. In case the CHILD passes to the next age group in the PRESCHOOL the Payment plan for the next academic year is signed not later than the 31st /thirty-first/ of May of the current year.
2.3. In case the PARENTS/GUARDIANS fail to sign the Payment plan for the next academic year until the date set out in article 2.2. above, the PRESCHOOL is not obliged to keep a place for the CHILD. If the signing is after the stated term the Tuition fee of the CHILD is in the amount determined for newly enrolled children.
2.4. In order to avoid doubts about the application of Art. 2.2., 3.1.3. and 3.1.4., the following cumulative conditions should be met:
The CHILD has passed an admission procedure described above (valid for newcoming children); A decision for a confirmed admission is taken on behalf of the PRESCHOOL (valid for newcoming children); The PARENTS/GUARDIANS have filled in correctly an Application for signing a Payment plan for the next school year at least 10 /ten/ working days before the announced deadline for signing of the Tuition Contract (valid for returning students).
2.5. Enrollment in the PRESCHOOL (valid for every school year):
2.5.1. In case the CHILD is enrolled in age groups 2-3 or 3-4 years old, then the CHILD needs to be enrolled in the period 1st /first/ of July – 31st /thirty-first/ of August.
2.5.2. In case the CHILD is enrolled in age groups 4-5 or 5-6 years old, then the CHILD needs to be enrolled not later than 1st /first/ of October.
2.6. Date of enrollment: The exact date shall be agreed with the PRESCHOOL's management. Without confirmation of the exact date and without the duly submission of the required documents according to the Admission procedure, the CHILD will not be enrolled in the PRESCHOOL.
2.7. If the PARENTS/GUARDIANS of the CHILD submit an Admission application in which the stated enrollment date at the PRESCHOOL is after the beginning of the school year, they owe a Reservation Fee of EUR 200 (two-hundred Euro) per month. The fee is due as of 1st /first/ of September of the academic year until the date of the CHILD enrollment.
2.8. Change in the initial choice of payment scheme of liabilities (requested electronically by the PARENTS/GUARDIANS prior to concluding the Tuition Contract and/or the Payment plan for the respective year) is allowed once only and such change is not charged. For each subsequent change of the Payment Plan, requested by the PARENTS/GUARDIANS, the latter owe a fee in the amount of EUR 50 (fifty). Change or amendment, after the conclusion of Tuition Contract and/or after signing the Payment plan for the respective year, is allowed in case of consent on behalf of the PRESCHOOL and in case the request is filed not later than 14 days term before the due date of the instalment, which is subject to the request for further rescheduling.
III. FINANCIAL CONDITIONS
3.1. Tuition fee for the respective year is in the amount set out in the Payment Plan, integral part of the Tuition Contract. For each subsequent school year, the amount of the Tuition fee is set out in a new Payment plan. For each year the PARENTS/GUARDIANS state how many installments they will pay the Tuition fee – one, two, three or ten installments for the period September- June and one or two for the period July-August.
3.1.1. The financial terms and conditions for each subsequent school year shall be announced in February of the current year. They are determined on the basis of inflation, period of contract conclusion, period of signing the Payment plan for a CHILD continuing his/her education, wage costs and staff qualification, developed and implemented training programs, improving the quality of the offered hereto and others at the discretion of the competent authority. Information about the Tuition Fee is published on the website www.stgeorgeschool.eu .
3.1.2. For a new CHILD, the Tuition fee and other fees according to the Payment plan are in the amount set for new children for the respective academic year, consistent with the published financial conditions.
3.1.3. For a current CHILD, continuing his/her education in the PRESCHOOL with a concluded Payment plan for the next academic year by 31st May (or other deadline set by the PRESCHOOL on the website) as well as payments made, the Tuition Fee is in the amount of the published fee for returning CHILDREN for the relevant age group.
3.1.4. For a current CHILD, continuing his/her education in the PRESCHOOL with a concluded Payment plan for the next academic year after 1st June of the current year, the Tuition Fee is in the amount of the published fee for new children for the relevant age group.
3.1.5. In case until 31st May of the current year (or other deadline published by the PRESCHOOL on its website), the PARENTS/ GUARDIANS fail to sign the Payment plan for the next academic year, the PRESCHOOL may terminate the concluded Tuition Contract in accordance with the provisions of art. 5.1.5. of these General Terms and Conditions, without extending any deadlines by sending a notification in writing to the PARENTS/ GUARDIANS to the e-mail address provided by them.
3.2. Reimbursement of the Tuition fee:
3.2.1. In case of prolonged absence due to MEDICAL reasons including due to isolation or quarantine within the meaning of §1 from the Additional provisions to the Health Law for over 10 /ten/ consecutive SCHOOL days and in case of interaction in an online environment was not offered to the CHILD or no consent of the PARENTS/GUARDIANS was obtained in this regard, the PRESCHOOL is obliged to reimburse 20 % /twenty percent/ of the Tuition Fee for the respective period to the PARENTS/GUARDIANS. The amount reimbursed is calculated for the days after the 10th /tenth/ school day until the first day of attendance of the CHILD and after presenting a medical document for the absences.
3.2.2. In case of prolonged absence due to MEDICAL reasons including due to isolation or quarantine within the meaning of §1 from the Additional provisions to the Health Law for over 10 /ten/ consecutive SCHOOL days and in case of interaction in an online environment was offered to the CHILD and in case a consent of the PARENTS/GUARDIANS was obtained in this regard (the method of tuition and the remote interaction are at the discretion of the PRESCHOOL and in an appropriate manner according to the age of the CHILD, current feedback for the tuition results), The PRESCHOOL is released from liability and does not owe a refund of the Tuition fee, additional compensations or penalties, both for time during which these circumstances apply and for any consequences that occur after the end of this period.
3.2.3. In case of circumstances according to art. 1.5.1.1. from these General Terms and Conditions and proposed interaction in electronic environment on behalf of the PRESCHOOL, when a consent of the PARENTS/ GUARDIANS is given, the PRESCHOOL is obliged to reimburse the PARENTS/ GUARDIANS 15 % /fifteen percent/ from the Tuition fee for the period of the offered interaction in electronic environment.
3.2.4. In case of circumstances according to art. 1.5.1.1. from these General Terms and Conditions but in view of the age of the CHILD or lack of consent of the PARENTS/GUARDIANS, due to which no interaction in electronic environment can take place, or in case when the PARENTS/GUARDIANS have chosen to receive learning materials via email, with no interaction in electronic environment, the PRESCHOOL is obliged to reimburse 20 % /twenty percent/ of the Tuition fee for the period after the 10th /tenth/ school day of suspension of the classes until the reasons for this cease to exist;
3.2.5. Recalculation of amounts from the Tuition fee including for absences for illness and declared vacation is performed twice a year – up to 28th /twenty-eighth/ of February and 31st /thirty-first/ of August. The Educational resources fee and the guarantee deposit are not subject to reduction and reimbursement.
3.2.6. When signing the Tuition Contract and/or the Payment plan for the subsequent school year, the PARENTS/ GUARDIANS submit Application/s through an online platform, wherein they fill in or update their personal data, bank account details designated for reimbursement of amounts.
3.2.7. Except in the cases for reimbursement (recalculation) explicitly regulated in these General Terms and Conditions for the period of force majeure events (natural disasters, accidents, state of emergency, war, epidemics, quarantine, etc.), the PRESCHOOL is released from liability and does not owe reimbursement of the Tuition fee, additional compensations and penalties both for the time during which these circumstances are in force, and for any consequences that occurred after the end of the period.
3.3. Until 15th /fifteen/ of May of the current school year, the PARENTS/GUARDIANS are obliged to inform in written form the PRESCHOOL for the days in July and in August, when the CHILD will be absent. Change in the stated absence days after the initial submission of information for the absences of the CHILD during the summer vacation is not allowed. If stated within the deadline, for the days of the declared vacation for July and August, the PARENTS/GUARDIANS shall pay 50 /fifty/ % of the due Tuition fee for the days of absence for the purpose of keeping the place of the CHILD.
3.3.1. In such cases the fee is calculated based on the absences declared by the PARENTS/GUARDIANS and the expected number of days of attendance. Full amount of the fee is due for the days of attendance, for the days of declared absences - 50 /fifty/ % of the monthly fee on a basis of 20 /twenty/ working days per month.
3.3.2. In case of unexpected absences of the CHILD (not due to medical reasons) during these months the full amount of the fee, as per the Payment plan for the respective school year is charged.
3.3.3. In case of failure to fulfill the obligation as per art. 3.3., the PARENTS/GUARDIANS are obliged to pay the full amount of the fee, regardless of the fact if the CHILD has attended the PRESCHOOL or not.
3.3.4. If the CHILD attends the PRESCHOOL during a period, declared as absence, the PARENTS/GUARDIANS owe the full amount of the fee, stated in the Payment plan for the respective school year.
3.4. Fee for individual care in case the CHILD stays at the PRESCHOOL 15 /fifteen/ minutes after the end of the working hours of the PRESCHOOL for the respective age group. The Fee is at the amount of EUR 15 /fifteen / Euro for every started hour. The PARENTS/GUARDIANS need to apply in advance for this service within 3 /three/ working days by email to sgp.reception@stgeorgeschool.eu , and the PRESCHOOL keeps the right to refuse this service. If the CHILD stays on the territory of the PRESCHOOL and there is no preliminary applied for this service, the PARENTS/GUARDIANS also owe a Fee for individual care. The duration of the stay shall be estimated based on extract from the PRESCHOOL’s access and security system, validating the date and time of the CHILD’s exit of the facilities. The fee due is paid until the 10th /tenth/ day of the month, following the month of the service as the invoice is displayed to the profile in the e-Payment portal of St. George Private Preschool.
3.5. Terms and deadlines for payment of the Tuition Fee:
3.5.1. The major currency in the fee forming is Euro. The amounts due to the PRESCHOOL shall be invoiced and paid in Bulgarian levs (BGN) as per the exchange rate of the Bulgarian National Bank on the date of payment using one of the following ways: through the e-Payment portal of St. George Preschool EOOD (by debit, credit card or by bank transfer), or through a bank transfer to the account specified in the Tuition Contract; or through the POS in the building of the PRESCHOOL.
3.5.2. The deadlines for payments under the Tuition Contract and other fees are stated in the Payment plan for every school year, an integral part to the Tuition Contract, and other payments are stated in the invoices issued by the PRESCHOOL.
3.5.3. The PRESCHOOL issues an invoice for each installment according to the Payment plan and displays the invoice on the profile of the PARENT/GUARDIAN in the e-Payment portal of St. George Preschool. In all cases the PRESCHOOL keeps the right to decline deferring of the fees according to the Payment plan, an integral part of the Tuition Contract of the CHILD.
3.5.4. By signing of the Tuition Contract and the Payment Plan for the respective school year, the PARENTS/GUARDIANS are considered informed about the amount, terms and deadlines for the payment of the Tuition Fee and other fees in connection to administration and organisation of the tuition process.
3.5.5. THE PARENTS/GUARDIANS accept that if the Currency Board of the Republic of Bulgaria would be canceled and/or altered, there would be a significant change in the economic conditions under which the Tuition Contract had been concluded. In this regard, the amounts due under the Payment Plan for the respective school year, an integral part of the Tuition Contract along with other amounts for services, will be revised and/or converted. The PARENTS/ GUARDIANS agree that the revision and/or the currency conversion shall occur automatically within 10 (ten) days from the date of the notification about the change of the PARENTS/ GUARDIANS to the email address for correspondence. In case they disagree, then the PARENTS/ GUARDIANS have the right to notify the PRESCHOOL that they do not accept the revision and/or the currency conversion and are willing to terminate the tuition contract within 10 (ten) days from the date of their notification, as the PRESCHOOL shall bear no responsibility for any expenses, compensations, material and non-material damages. Should there is no declared intention for termination on behalf of the PARENTS/ GUARDIANS within the term set, the PRESCHOOL shall deem that the PARENTS/ GUARDIANS accept the change, and it shall come into effect after the 10-day term expiry. Further, the PRESCHOOL shall elaborate a new Payment Plan, an integral part of the Tuition contract, which shall be sent for information and execution to the PARENTS/ GUARDIANS to the email address for correspondence given by them.
3.5.6. After publishing the size of the Tuition fee or after signing the Tuition contract and/or the Payment plan for the respective year, also during the school year, the PRESCHOOL is entitled to revise the Tuition fee in November and in April. Any revision shall be calculated proportionately to the school days until the end of the school year with accumulation, as the relevant summary consumer price index (CPI) shall be added for each of the past months, namely: in November – summary CPI in total for the months from March until October and in April – summary CPI in total for the months from November until March.
3.5.6.1. The revisions in conformity with art. 3.5.6. are as follows:
Should the total summary consumer price index (CPI) for the months mentioned above, published by the National Statistical Institute (NSI) for group “Education” is: 1.1. With increase up to 3% - the PRESCHOOL shall revise the Tuition fee up to 1.65%;
1.2. With increase from 3.01% to 5.00% - the PRESCHOOL shall revise the Tuition fee by up to 2.75%;
1.3. With increase from 5.01% to 10.00% - the PRESCHOOL shall revise the Tuition fee by up to 5.50%;
1.4. With increase from 10.01% to 15.00% - the PRESCHOOL shall revise the Tuition fee by up to 8.25%;
and/or
Should the total summary consumer price index (CPI) for the months mentioned above, published by the National Statistical Institute (NSI) for consumer group “Housing, water, electricity, gas and other fuels” is: 2.1. With increase up to 3% - the PRESCHOOL shall revise the Tuition fee up to 0.27%;
2.2. With increase from 3.01% to 5.00% - the PRESCHOOL shall revise the Tuition fee by up to 0.45%;
2.3. With increase from 5.01% to 10.00% - the PRESCHOOL shall revise the Tuition fee by up to 0.90%;
2.4. With increase from 10.01% to 15.00% - the PRESCHOOL shall revise the Tuition fee by up to 1.35%;
3.5.6.2. The revised fee is a base for performing subsequent revision/s in the above order by the percentages listed above as well as under the conditions of alternativity.
3.5.6.3. The PARENTS/ GUARDIANS agree that the revision shall occur automatically within 10 (ten) days from the date of the notification for the change of the PARENTS/ GUARDIANS to the email address for correspondence. In case they disagree, then the PARENTS/ GUARDIANS have the right to notify the PRESCHOOL that they do not accept the revision and are willing to terminate the tuition contract within 10 (ten) days from the date of their notification, as the PRESCHOOL shall bear no responsibility for any expenses, compensations, material and non-material damages. Should there is no declared intention for termination on behalf of the PARENTS/ GUARDIANS within the term set, the PRESCHOOL shall deem that the PARENTS/ GUARDIANS accept the change and it shall come into effect after the 10-day term expiry. The PRESCHOOL shall issue an invoice for the additional payment of the revised fees, as the information /invoice/ is visible in the PARENTS/ GUARDIANS profile in the e-Payment portal of St. George Private Preschool.
3.5.6.4. The termination of the Tuition Contract by the PARENTS/ GUARDIANS pursuant to art. 3.5.6.3. is performed in line with art. 5.1.3. of these General Terms and Conditions.
3.5.7. For the provision of nutrition for the CHILDREN the PRESCHOOL has concluded a contract with a third party – vendor. In case after the publishing of the size of the Tuition fee (where the Food fee is included) or after signing the Tuition Contract and/or the Payment plan for the respective year, also during the school year, an increase of the services provided by the third party – vendor shall occur, the PRESCHOOL is entitled to increase the Tuition fee by the percentage of the increased expenses of the vendor. In that case art. 3.5.6.3. and art. 3.5.6.4. above are applicable.
3.5.8. For the avoidance of any doubt, art. 3.5.6. and art. 3.5.7. above are applicable regardless of art. 2.3. of the Tuition contract of a CHILD, which is always applied independently.
3.5. 9 . In case the Tuition Fee and/or other fees due to the PRESCHOOL have not been paid within the stipulated period, the PRESCHOOL would have no obligation to send notification or an invitation to the PARENTS/ GUARDIANS to pay .
3.6. Guarantee deposit:
3.6.1. The PARENTS/GUARDIANS are obliged to pay to the PRESCHOOL a guarantee deposit which is a lump-sum, which amount has been defined by the Governor of St. George Private Preschool EOOD within 3 /three/ working days from signing of the Tuition Contract. In line with the Bulgarian legislation, no invoice is issued related to the guarantee deposit payment.
3.6.2. The guarantee deposit could be used and disbursed by the PRESCHOOL in the following cases:
3.6.2.1. It serves as a guarantee for keeping the place of the CHILD until payment of the Tuition Fee. In case the PARENTS/GUARDIANS fail to make the payment under the Tuition Contract as per the Payment Plan theretofore the respective school year and/or the CHILD fails to visit the PRESCHOOL within 30 /thirty/ calendar days of the date set out in the Contract, the guarantee deposit is not subject to reimbursement;
3.6.2.2. For covering any amounts due and not paid in relation to the Tuition Contract and Payment Plans from the different school years and/or Annexes thereof, and/or other fees and amounts due to the PRESCHOOL, including amounts due for „Activities by interests” or “Individual care” fee, services, activities, etc.
3.6.2.3. For covering any amounts due for using the underground parking of the PRESCHOOL (according to the Regulations for use of the parking and Fees to it).
3.6.2.4. As a compensation for damages caused by the CHILD to the facilities used for the tuition process, movable and immovable property used by the PRESCHOOL.
3.6.2.5. For compensation, in case of non-return in due time by the PARENTS/GUARDIANS when terminating the Tuition Contract, including but not limited to loss, damage, destruction and others of textbooks, school accessories and materials, provided by the PRESCHOOL;
3.6.2.6. For covering of due and unpaid amounts, for events visited by the CHILD, for accessories provided to the CHILD or the PARENTS/GUARDIANS, including costs for re-issue of an access card/s for access to the building of the PRESCHOOL – in case of loss or damage of it, and others according to the Rules for safe access to the building (https://stgeorgeschool.eu/about/documents-and-policies/);
3.6.2.7. For collecting penalties and compensations and other amounts due to the PRESCHOOL;
3.6.2.8. As a compensation for not enrolling of the CHILD in the PRESCHOOL within the terms, fixed in the Tuition Contract and termination of the Tuition contract with the PRESCHOOL.
3.6.3. By signing these General Terms and Conditions, the PARENTS/GUARDIANS are hereby considered informed in advance that in case of using any amounts from the guarantee deposit, the PARENTS/GUARDIANS are obliged to recover the full amount of the guarantee deposit within 14 /fourteen/ calendar days of receiving the notice from the PRESCHOOL to this effect. In case of failure to do so, the PRESCHOOL may undertake the measures under Sections IV and V of the present General Terms and Conditions.
3.6.4. The remaining unused amount of the guarantee deposit, after deducting of all due amounts, is subject to reimbursement to a bank account specified within the Application with personal data for preparation the Tuition contract or Payment plan for the next school year by the PARENTS/GUARDIANS within 14 /fourteen/ calendar days from the termination of the Tuition Contract.
3.6.5. In case of continuing the CHILD’s tuition in the PRESCHOOL, the guarantee deposit is transferred for the next school year. In case of continuing of the tuition of a child form the PRESCHOOL to St. George International School, the guarantee deposit may be transferred for the tuition of the CHILD in the school.
3.7. Educational resources fee includes:
3.7.1. Using and subscribing to on-line platforms, main and additional textbooks, teaching materials, practical trainings.
3.7.2. The amount of the fee is described in the Payment Plan for every school year. The educational resources fee is non-refundable in case of termination of the Contract and is due along with the first installment according to the Payment Plan chosen by the PARENTS/GUARDIANS.
3.8. Food:
3.8.1. During school days the PRESCHOOL provides the following meals for the CHILD: morning breakfast, light meal at 10.00 a.m., lunch and afternoon snack. CHILDREN are obliged to eat the offered food.
3.8.2. The price of the food is included in the Tuition Fee and is not paid additionally by the PARENTS/GUARDIANS.
3.8.3. Denial of food may be made only in case of a medical problem of the CHILD requiring the observance of strict dietary regime. Pursuant to instructions of the Bulgarian Food Safety Agency, AS AN EXCEPTION, the PARENTS/GUARDIANS are granted authorization for providing food prepared by them at home. In this case, the PARENTS/GUARDIANS submit an Application to the Reception of the Preschool and enclose documents verifying the CHILD’s need of diet – statement by the Territorial Expert Medical Commission or a medical certificate issued by a commission or a specialist for the respective disease. The Application and the enclosed documents are reviewed by the management within 7 /seven/ working days. In case of impossibility to provide the food required for the CHILD, decision is made for termination of the service by the PRESCHOOL. The home-made food is delivered in the PRESCHOOL on a daily basis packed in disposable utensils with the names of the CHILD specified on them. The liability for the quality and safety of such home-made food and any possible consequences thereof is fully borne by the PARENTS/GUARDIANS who declare in writing that they bear such liability.
3.9. When signing the Tuition Contract, the PARENTS/GUARDIANS submit Application/s through the online platform for the following services and activities for which additional fee is paid:
3.9.1. Activities by interests of the CHILDREN include:
3.9.1.1. Group or individual activities aimed at the personal development and improvement of the CHILD within time limits set out by the PRESCHOOL, in different thematic areas. The PARENTS/GUARDIANS can apply for Activities by interests within a period set by the PRESCHOOL through the e-Payment Portal of the PRESCHOOL,
3.9.1.2. For the participation of the CHILD in Activities by interests, the PARENTS/GUARDIANS of the CHILD owe a fee in the amount of the applied for activities. The Activities by interests Fee for the different periods are paid within the stated deadline in the relevant invoice.
3.9.1.3. For the period from 1st /first/ of July until 20th /twentieth/ of August Activities by interest are applied for and paid for the weeks requested for attendance of the CHILD in the PRESCHOOL. In case of absence of the CHILD during the requested for attendance week, the amount for the unconducted Activities by interests is not reimbursed to the PARENTS/GUARDIANS.
3.9.1.4. In case of absence of the CHILD from the requested Activities by interests – the fee (or part of the amount of the activities not taking place) is not subject to reimbursement and the PRESCHOOL is not obliged to compensate in any way the activities of the CHILD that did not take place.
3.9.1.5. In case of unconducted Activities by interests due to danger or epidemic spread of contagious diseases, determined by the respective act/order from the State or Municipal body – the amount for the activities not taken place is reimbursed to the PARENTS/GUARDIANS as the recapitulation is made on an annual base until 31st /thirty-first/ August.
3.9.1.6. In case of unconducted Activities by interests due to reasons other than the one mentioned in art. 3.9.1.5. above, which are not by fault of the PRESCHOOL, the due fee or part of the amount of the unconducted activities is not reimbursed and the PRESCHOOL is not obliged to compensate in any way the unconducted activities of the CHILD.
3.9.1.7. In case of unconducted Activities by interests due to reasons other than the one mentioned in art. 3.9.1.5. above, and namely due to inability to gather a group and a minimum number of participants or lack of a trainer/teacher/educator, lack of a hall, room, space, outside area, swimming pool and unconducted activities due to other events – the amount for the activities that did not take place is reimbursed to the PARENTS/GUARDIANS as the recapitulation is made on an annual basis until 31st /thirty-first/ August.
3.9.2. Provision of services such as “green” and “white” schools or other organised events are held after additional payment from the PARENTS/GUARDINAS of the CHILD.
3.10. Transport:
3.10.1. The transport service is provided for the CHILD at the age of 3 years or older who has the necessary habits and readiness to use the service, after submission of an application for the service, for the purpose of which an explicit individual contract for transport with the transportation company selected by the PRESCHOOL is concluded under the determined by the company tariff for transportation for the respective school year. The PRESCHOOL is not a party under the concluded contract and is not responsible for any damage and harm caused due to incorrect performance of the transportation contract, including, the quality of the service, the schedule, the routes, and it does not owe any compensations or penalties.
3.11. Discounts:
3.11.1. In case of tuition of a second and every other CHILD of one family enrolled in the St. George International School and/or the PRESCHOOL, a 5% (five percent) discount from the Tuition Fee for the respective year may be applied, for each subsequent child – 10% (ten percent), and for twins – 15% (fifteen percent) for one of the twins.
3.11.2. Discounts shall not apply to: guarantee deposit, administrative fee, educational resources fee, “green” and “white” schools, and participation in Activities by interests, etc.
3.11.3. In case the Tuition Fee and/or Fees for Use of Education Resources are not paid within the time frames set out in the Payment Plan for the respective school year, in the invoices or in the e-mail correspondence, all applied discounts from fees under the Tuition Contract and the Payment Plan for the respective school year, agreements to it, or previous written annexes or agreements will become invalid, and the PARENTS/GUARDIANS owe the full amount of the Tuition Fee for new coming children with signed contract after 1st June in one installment. In case of delay, the PARENTS/GUARDIANS shall be deemed notified and unconditionally agree that the revocation of the discounts as well as the change of the Tuition Fee will automatically occur on the day, following the due day. The PRESCHOOL shall send the amended Payment Plan, an integral part of the Tuition Contract, to the e-mail addresses indicated by the PARENTS/GUARDIANS and the amount for the additional payment is invoiced, and the invoice is displayed in the e-Payment Portal.
3.11.4. Even if the Tuition Contract is signed under the terms stated in art. 3.1.3. and art. 3.1.4. above and in compliance with the conditions under art. 2.4. and the CHILD’s Tuition Fee is in the amount of the announced fee for returning children with a contract concluded by and including 31st May, in case the Tuition Fee and/or a fee for use of educational resources are not paid in full within the deadlines specified in the Payment Plan for the respective school year, issued invoices or in electronic correspondence, the amount of the Tuition Fee shall be changed and the PARENTS/GUARDIANS shall owe the full amount of the announced annual Tuition Fee for new children with a signed contract after 1st June in one installment. In case of delay, the PARENTS/GUARDIANS are notified and unconditionally agree that the change of the Tuition Fee will occur automatically on the day following the due date. The PRESCHOOL shall send the amended Payment Plan, an integral part of the Tuition Contract, to the e-mail addresses indicated by the PARENTS/GUARDIANS and the amount for additional payment is invoiced and the invoice is displayed in the e-Payment Portal.
LIABILITY IN CASE OF FAILURE TO PAY 4.1. In case a fee as per the Payment Plan, an integral part of the Tuition Contract and/or fee for Activities by interests or other amounts due to the PRESCHOOL is not paid within the described deadlines, in addition to the other consequences as provided for in the Tuition Contract, the General Terms and Conditions and the applicable law, the PARENTS/GUARDIANS owe the PRESCHOOL a penalty for delay of 0,5 /zero point five/ % of the unpaid amount for each day of delay, but not more than 20 /twenty/ % of the amount due. In case the obligation to pay the Tuition Fee payment is not sufficient to cover the calculated penalty and the capital, it is necessary that first the entire penalty is paid and afterwards the capital. Additional penalty on the remaining capital is calculated due to payment delay in the order of the previous sentence until its full payment.
4.2. In case of failure to pay the full or any part of the Tuition Fee, also payments due under the Payment Plan for the respective school year, an integral part of the Tuition Contract, including fees for requested Activities by interests, guarantee deposit (including for cases according art. 3.6.3. above), etc., within 10 /ten/ working days after the expiration of the stated in the Payment plan, issued invoices or electronic correspondence deadlines, in addition to the other consequences as provided for in the General Terms and Conditions and the applicable law, the PRESCHOOL may send a written reminder, giving the deadline of 10 /ten/ working days for payment, with the strict notice that after the expiry of the deadline it is entitled to terminate the Tuition Contract with immediate effect. The termination is performed by unilateral written statement to the PARENTS/GUARDIANS, without notice and without any additional period for performance.
TERMINATION OF THE TUITION CONTRACT. REIMBURSEMENT OF PAID FEES 5.1. The Tuition Contract is terminated:
5.1.1. Upon expiration of the term of validity thereof.
5.1.2. By mutual consent expressed in writing.
5.1.3. With one-month written notice by any of the parties served to the other party, without highlighting the reasons for terminating the contract.
5.1.4. Unilaterally by the PARENTS/GUARDIANS, without one-month notice and by paying all due amounts and the penalty as per article 5.3. below.
5.1.5. By the order of art. 3.1.5. of these General Terms and Conditions – the Contract is considered terminated as of 31st August.
5.1.6. In case of permanent deterioration of the CHILD’s medical condition or other reasons that makes him/her unable to continue the education.
5.1.7. Upon closing of the PRESCHOOL.
5.1.8. In case of failure to pay full or part of the Tuition Fee according to the Payment Plan and/or fees for requested Activities by interest, guarantee deposit (including for cases according to art. 3.6.3. above), penalties due and amounts due for using the underground parking according to art. 4.2. above.
5.1.9. In case of force majeure events (war or destructive natural disasters, such as flood, earthquake, fire and disasters of other similar nature), which make the building unsuitable for its intended purpose or which make the fulfillment of the PRESCHOOL’s obligations impossible for a period longer than 6 /six/ months – with unilateral notice served by the PRESCHOOL to the PARENTS/GUARDIANS. In this case the termination is in effect as of the date of receipt of the PRESCHOOL’s notice by the PARENTS/GUARDIANS.
5.1.10. The PRESCHOOL has the right to terminate the Tuition contract also upon judgment of the Governor of St. George Private Preschool EOOD, including but not only when the CHILD and/or PARENTS/GUARDIANS or any persons authorized thereby violate the present General Terms and Conditions, the obligation not to disclose Confidential information within the meaning of Section V from the Tuition contract, the Rules for safe access to the building or legal documents of the PRESCHOOL including regulations and procedures described on the web page of the PRESCHOOL (https://stgeorgeschool.eu/about/documents-and-policies/), in case of non-attendance by the PARENTS/GUARDIANS without any valid reason to an individual invitation for a meeting by the Head of the PRESCHOOL, pedagogical staff or the management of the PRESCHOOL, as well as when performing actions which damage the reputation of the PRESCHOOL and/or the teachers, children and administrative staff. The termination is made by unilateral written statement to the PARENTS/GUARDIANS, without notice and without any additional period for performance.
5.1.11. If after the contract has entered into force, it is revealed that the PARENTS/GUARDIANS have submitted untrue, incorrect or incomplete information regarding health, physiological or other personal specifics of the CHILD (including individual educational needs, difficulties in the physical, cognitive, linguistic, social, sensor, emotional, creative development of the CHILD compared to other children of the same age group) – the contract is terminated with one-month notice.
5.1.11. Under the terms and conditions of art. 6.2.1.1. below.
5.2. In the events under articles 5.1.2., 5.1.3., 5.1.4., 5.1.5., 5.1.6., 5.1.7., 5.1.9., 5.1.10. and 5.1.11., the PRESCHOOL is obliged to reimburse the PARENTS/GUARDIANS with the proportionate part of the paid Tuition Fee within 14 /fourteen/ working days after the termination of the contract enters into force to a bank account indicated by both PARENTS/GUARDIANS.
5.3. Upon termination of this contract unilaterally by the PARENTS/GUARDIANS, without observing the 30 /thirty/ calendar days’ notice period, they owe the PRESCHOOL a penalty at the amount of 1000 /one thousand/ Euro.
5.4. The Tuition Fee is not subject to reimbursement in case of CHILD’s absence different from the absences under art. 3.2., art. 3.2.3., art. 5.1.2, 5.1.3, 5.1.4, 5.1.5., 5.1.6., 5.1.7., 5.1.9., 5.1.10. and 5.1.11., hereinabove.
5.5. The PRESCHOOL has the right to make objection for failure to perform a contract and not fulfill an obligation for reimbursement of fees and guarantee deposit on the grounds of art. 3.2., art. 3.2.3., art. 5.1.2, 5.1.3, 5.1.4, 5.1.5., 5.1.6, 5.1.7., 5.1.8., 5.1.9. and 5.1.11., if the PRESCHOOL has receivables from the PARENTS/GUARDIANS under the Tuition Contract and/or requested Activities by interests and other services, including and/or fees for using educational resources, guarantee deposit, parking fee, penalties, where the PARENTS/GUARDIANS have failed to make any payments for such receivables, until the full payment of the obligations of the PARENTS/GUARDIANS.
5.6. The termination of the Tuition Contract does not extinguish/terminate any of the rights or obligations of each Party, which have occurred before the date of termination and have not been fully or partially fulfilled.
RIGHTS AND OBLIGATIONS OF THE PARENTS/GUARDIANS 6.1. Rights of the PARENTS/GUARDIANS:
6.1.1. To receive high quality tuition and care for the CHILD according to the State Educational Standards of the Ministry of Education and Science of Bulgaria, according to the age group.
6.1.2. To receive foreign language education of the CHILD according to the curriculum in the PRESCHOOL.
6.1.3. To be informed about the development of the CHILD, as well as about every important fact of her/his daily life or behavior by means of daily and weekly reports (depending on the age group the CHILD).
6.1.4. To maintain contact with the team taking care of the CHILD as well as to have access to the building in a way that does not violate the order and the organisation of the PRESCHOOL as provided for in the Rules for the Organisation and Work of the PRESCHOOL, as well as the Rules for using the parking, etc.
6.1.5. To apply for use of Activities by interests.
6.1.6. To apply for type of menu: standard or vegetarian.
6.1.7. To be informed about:
6.1.7.1. The Rules for safe access to the building, normative and internal documents of the PRESCHOOL (http://stgeorgeschool.bg/?page_id=9474&lang=bg);
6.1.7.2. The annual Tuition Fee and all other fees and costs, pursuant to the present Tuition Contract as well as with the payment deadlines.
6.2. Obligations of the PARENTS/GUARDIANS:
6.2.1.To submit all information that is required or might be required for the fulfillment of the PRESCHOOL’s obligations under this contract within the deadlines defined by the PRESCHOOL – in relation to the health, physiological or other personal characteristics of the CHILD (including individual educational needs, difficulties in the physical, cognitive, linguistic, social, sensor, emotional, creativity development of the CHILD in comparison with the children of the same age group), requirements, etc.
6.2.1.1. In case of need of additional resources, assistant or accompanying person, in connection with the individual needs for the education of the CHILD and upon a motivated request by the Management of the PRESCHOOL, they shall pay an additional fee Additional resources and provide an assistant on their own expense. In case the fee is not paid, the PRESCHOOL may terminate the Tuition Contract with a one-week written notice.
6.2.2. To maintain regular contact with the assigned persons for communication and the management of the PRESCHOOL in appropriate order.
6.2.3. To cooperate with the PRESCHOOL for protecting the property and observing the internal order, the Rules for the organisation of the access of the PARENTS/GUARDIANS to the school building, premises, parking and adjacent areas, the cleanness and safety in the PRESCHOOL by the CHILD and/or by authorized by them persons.
6.2.4. To observe the provisions of the Rules for the Organisation and Work of the PRESCHOOL and to procure the observance thereof by the CHILD including of all normative and internal documents of the PRESCHOOL (https://stgeorgeschool.eu/about/documents-and-policies/), as well as not to perform actions which damage the reputation of the PRESCHOOL and/or the teachers, children and administrative staff;
6.2.5. To cooperate if necessary, with the PRESCHOOL for maintaining the order, discipline, successful educational process and the normal personal development of the CHILD.
6.2.6. Prior to the first day but not earlier than 3 /three/ days prior to the attendance in the PRESCHOOL to present health declaration prepared as per the template of the PRESCHOOL, Personal Health Card of the CHILD with recorded vaccines according to the official vaccine calendar of Bulgaria, medical note for lack of contact with contagiously ill people and parasites, medical document for discovered allergies of the CHILD, if any, as well as blood and urine examination results, parasitology and if the CHILD is below 3 years of age – also HIV and Wassermann checks of one of the PARENTS/GUARDIANS;
6.2.7. Not to allow the CHILD to bring with him/her and/or to go to PRESCHOOL with objects that are or might be potentially dangerous for the health and/or the security of the CHILD and other children or the PRESCHOOL’s staff.
6.2.8. Not to allow the child to PRESCHOOL in case it is contagiously ill and there is a possibility to contaminate other children in the PRESCHOOL or in case there are parasites:
6.2.8.1. In case of illness of the CHILD the PARENTS/GUARDIANS are obliged to immediately inform the Head of the PRESCHOOL by sending an email to Reception (sgp.reception@stgeorgeschool.eu ) for the nature of illness in order that necessary precaution measures are undertaken for the other children.
6.2.8.2. If, in the course of the day, the CHILD is defined ill or has symptoms of illness or parasites are found, which according to the considerations of the medical staff are assessed as danger for the CHILD or the other children, the PARENTS/GUARDIANS should provide for the immediate departure of the CHILD from the PRESCHOOL.
6.2.8.3. On the first day of resuming the attendance of the CHILD in the PRESCHOOL after periods of illness, the PARENTS/GUARDIANS should present a medical note from the family doctor, certifying that the CHILD is clinically healthy. On the first day of resumed attendance of the CHILD in the PRESCHOOL after parasites were discovered, the PARENTS/GUARDIANS should present a medical note from the family doctor, certifying that the CHILD is clinically healthy and has no parasites.
6.2.9. To attend all organised parent’s meetings and events.
6.2.10. To attend if invited to individual meetings with the Management of the PRESCHOOL, teacher or a psychologist.
6.2.11. In case the CHILD needs to be picked up from the PRESCHOOL by persons, different from the PARENTS/GUARDIANS and those stated in the Letter of Attorney, who are authorized to pick up the CHILD from PRESCHOOL, the PARENTS/ GUARDIANS should inform the Head of the PRESCHOOL in advance by using the stated in art. 7.4. of the Tuition contract email, in written form, by sending out a filled-in and signed Letter of Attorney for pick up by third parties to the official email of the PRESCHOOL (sgp.reception@stgeorgeschool.eu ). Sample of the Letter of Attorney is published on the official website of the Preschool (www.stgeorgeschool.eu ). In case of lack of a Letter of Attorney by a PARENT/GUARDIAN, which authorizes a third party or in case of an inaccurately submitted Letter of Attorney, the PRESCHOOL has the right to refuse the pick-up of the CHILD by a third party, different from the PARENTS/GUARDIANS.
6.2.12. To inform in written form the PRESCHOOL to the official email of the Reception (sgp.reception@stgeorgeschool.eu ) for any change in the family or in the state of the CHILD, which is important for the fulfillment of the obligations as per the present contract;
6.2.13. To sign declaration of consent or dissent for any case when the CHILD leaves the PRESCHOOL in relation to the events organised by the PRESCHOOL;
6.2.14. At the beginning of each school year, to sign and submit to the PRESCHOOL a declaration for the medical condition of the CHILD which describes in detail all medical problems of the CHILD, if any, as well as any other declarations whatsoever required by the PRESCHOOL. Any change in the health of the CHILD should be immediately communicated in written form to the PRESCHOOL to the official email of the PRESCHOOL (sgp.reseption@stgeorgeschool.eu ), whereas the PRESCHOOL is not responsible for the CHILD’S health condition in case of untimely reporting.
6.2.15. To observe all provisions of the Tuition Contract with the PRESCHOOL in relation to the provision of high-quality education, the organisation and administration of the obligatory and facultative curriculum of the PRESCHOOL.
6.2.16. To pay the Tuition Fee and any other fees and expenses
in connection to the organisation and administration of the tuition process, fees for requested Activities by interest, as well as fees for stay in the underground parking, used by the PRESCHOOL, penalties due under the conditions and within the time periods set out in the Payment Plan for the respective school year and/or invoices or electronic correspondence when applicable.
6.2.17. To provide the necessary items from the PRESCHOOL uniform of the CHILD and to send the CHILD to PRESCHOOL in clean and neat appearance, according to the adopted Uniform policy of the PRESCHOOL.
6.2.18. In all cases of Contract termination to return until the date of the Contract termination enforcement all textbooks, educational resources and materials or books, etc., provided by the PRESCHOOL.
6.2.19. In case of interaction with the CHILD in a remote electronic environment by using the means of information and communication technologies, the PARENTS/GUARDIANS are obliged to: 1. Provide all necessary documents required by the government/Municipal authorities in connection with the education (if necessary); 2. To provide the necessary technical means for carrying out remote learning; 3. To exercise the necessary supervision and control for a safe and secure electronic environment of the CHILD, as the PRESCHOOL does not bear any responsibility for this.
2.20. To inform in writing the PRESCHOOL within 14-days term following a change of the bank account, stated in the Application for preparation the Contract or Payment plan for the next school year, used for reimbursement of amounts. In case of delayed notification, the PRESCHOOL bears no responsibility for any reimbursed amount to the initially declared bank account, as well the PRESCHOOL shall not be obliged to refund the PARENTS/ GUARDIANS with the amount transferred therein.
VII. RIGHTS AND OBLIGATIONS OF THE PRESCHOOL
7.1. Rights of the PRESCHOOL:
7.1.1 To receive from the PARENTS/ GUARDIANS the entire information that is required or might be required for the fulfillment of its obligations under this contract – in relation to the medical, physiological or other personal characteristics of the CHILD (including personal educational needs, difficulties in the physical, cognitive, linguistic, social, sensor, emotional, creativity development of the CHILD in comparison with the children of the same age group), requirements, etc.
7.1.2. To obtain from the PARENTS/GUARDIANS the whole necessary support for the qualitative performance of the obligations as per the Contract, including - for strengthening of the habits of the CHILD in a family environment, encouraging the positive attitude towards the PRESCHOOL, the teachers and the entire educational process; for provision of healthy and safe environment for development for all children at the PRESCHOOL.
7.1.3. To send to the PARENTS/GUARDIANS or to publish pictures or video materials captured during the tuition process, out-of-school activities, contests, excursions, etc. as part of its Communication Policy. Publications may be made on the official website and on other webpages, documents, articles and publications in preschool and other media, presentations, advertising materials, etc. By signing the Tuition Contract, the PARENTS/GUARDIANS express their consent to this effect. In case of dissent, the PARENTS/GUARDIANS sign a declaration to refuse capturing, including shooting videos with the CHILD. In such case the CHILD will be asked not to participate in events in order to avoid his appearance on the joint photos.
7.1.4. To receive all amounts due within the time periods and under the conditions set out in the Payment Plan for the respective school year, an integral part of the Tuition contract, including payment of the additionally requested via email or online platform Activities by interests and/or other services, parking fee, penalties.
7.1.5. To implement a system for access control and video surveillance in the PRESCHOOL under its own choice and consideration.
7.1.6. During school days to provide the CHILD with food.
7.1.7. To set rules for behavior, assessment of progress, uniform and appearance of the CHILD.
7.2. Obligations of the PRESCHOOL:
7.2.1. The PRESCHOOL is obliged to take care as a good professional by organising, managing and controlling the whole educational process and cares of the CHILDREN in a way, which is compliant with the legal requirements and the individual needs of the CHILD, including by means of: use of highly qualified staff; ensuring the necessary level of hygiene inside and around the building; ensuring of safe and stimulating conditions for the normal development of the CHILD and others.
7.2.2 Identification of logopaedic status – twice a year for children who are aged 4 years and above.
7.2.3. To provide a manufacturer for the uniform of the CHILD approved by the PRESCHOOL. The fee of the uniform is not included in the tuition fee and is paid by the PARENTS/GURADIANS on the basis of the choice made in regard to the type and number of items requested.
VIII. OTHER PROVISIONS
8.1. The PRESCHOOL has the right to refuse the continuation of the tuition of the CHILD in the PRESCHOOL for the next school year and signing the Payment plan for it under its own consideration, without being liable of any expenses or compensations whatsoever including the case when all amounts due under the Tuition Contract, including the additionally applied for by the PARENTS/GUARDIANS through the online platform Activities by interests and/or services, related to the CHILD are not paid in full or have been delayed, according to the Payment Plan and/or invoices and/ or according to terms stated in the email correspondence, when applicable. The above is also applicable in case the PARENTS/GUARDIANS do not systematically follow the rules and procedures (https://stgeorgeschool.eu/about/documents-and-policies/ ) or damage the reputation of the PRESCHOOL and/or teachers, children and administrative staff.
8.2. Notwithstanding art. 2.3. of Tuition Contract and art. 3.5.6. of these General Terms and Conditions, after signing of a Payment plant for the respective school year, the PRESCHOOL is entitled twice per year – in November and in April to index the Tuition fee with the consumer price index published by NSI consumer group “Other services, not included elsewhere”. Any revision shall be calculated proportionately to the school days until the end of the school year with accumulation (the revised fee is a base for performing subsequent revisions), as the relevant summary consumer price index (CPI) shall be added for each of the past months, namely: in November – summary CPI in total for the months from March until October and in April – summary CPI in total for the months from November until March. In this hypothesis the provisions of art. 3.5.6.3., art. 3.5.6.4. and art. 3.5.8. of these General Terms and Conditions are applicable.
8.3. The Parties shall hereby agree that in case of failure to fulfill the contractual provisions by the PARENTS/GUARDIANS, the PRESCHOOL shall be entitled to assign and subcontract any of its rights and obligations as per the Contract to third parties, for which the PARENTS/GUARDIANS give their prior unconditional consent. In case of PARENTS/GUARDIANS’ failure to perform the obligation for payment of any part of the Tuition Fee, due in accordance with the Payment Plan and/or according to terms stated in the email correspondence, when applicable, the PRESCHOOL shall be entitled to assign to a subcontractor to undertake actions for out-of-court collection of the delayed amounts, for which the PARENTS/GUARDIANS give their prior unconditional consent.
By signing these General Terms and Conditions, the PARENTS/GUARDIANS hereby declare that they have received them, are aware of them and acknowledge them as integral part of the Tuition Contract. The PARENTS/ GUARDIANS agree and unconditionally accept that in case these General Terms and Conditions are being electronically signed using the electronic signature through the Docusign signature platform, the placed electronic signatures would have the power of handwritten signatures and would have the formal evidential power pursuant to art. 13, para. 4 by the Electronic Documentation and Electronic Certifying Services Act.
These General Terms and Conditions are adopted and amended by the Governor of Private Preschool Saint George EOOD and refer to contracts, signed for students, enrolled as of 2022/2023 school year.
